On Personal Data Breach

‘Personal data breach’ means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data transmitted, stored or otherwise processed.

Remember that a data breach may be accidental. It does not have to be intentionally caused or with malice to be considered as a data breach.

Also remember that a data breach may or may not involve third persons.

Also remember that a data breach does not only mean unauthorized access. It encompasses loss, alteration, disclosure and access. It is possible to have a breach even if the actual contents of the data breach have not been read.

Loss means total loss. If there’s a backup, there is no loss, though it may still be considered as breach if there’s accompanying unauthorized access.
